JOINT LIABILITY RELEASE AND ASSUMPTION OF RISK

General Diving and Boat Operations 2003

I, ________________________________________ (Diver), hereby affirm that I have been

advised and thoroughly informed of the hazards of skin diving, scuba diving, and associated boat operations as conducted by the above parties:

______ I understand this Liability Release and Assumption of Risk (Release) hereby encompasses and applies to all diving activities in which I choose to participate and/or associated boating operations. These specialized diving activities include, but are not limited to boat handling, and, navigation, night, deep, altitude, boat, drift, dry suit, wreck, multilevel, search and recovery, underwater naturalist, underwater photography, and underwater videography dives.

______ Further, I understand this Release encompasses and applies to all dive activities in which I choose to participate that are introduced as part of any PADI programme. These dives may include but are not limited to navigation, night, deep, altitude, boat, drift, dry suit, wreck, multilevel, search and recovery, underwater naturalist, underwater photography, and underwater videography dives.

______ I understand and agree that this Release applies to all Instructors, Divemasters, employees, agents, and assigns of White Horse Diving, and/or the Seahorse Dive Club, through which such activities as identified above are organised.

______ Further I understand that scuba diving involves certain risks including decompression sickness, embolism, or other hyperbaric injuries that require treatment in a recompression chamber. I further understand that the diving trips, which are necessary for training and for pleasure and experience, may be conducted at sites that are remote in time, distance or both, from such a recompression chamber. Despite possible lack of a recompression chamber near the dive site, I still choose to proceed with such dives.

______ I understand and agree that neither my Instructors, Divemasters, nor White Horse Diving, nor the Seahorse Dive Club, nor International PADI Inc, nor any of their respective employees, officers, agents, or assigns (hereinafter referred to as “Released Parties”) may be held liable or responsible in any way for any injury, death, or other damages to me or my family, heirs, or assigns that may occur as a result of my participation in these diving activities, or as a result of the negligence of any party, including the Released parties , whether passive or active.

______ As a condition of being allowed to participate in these Diving activities, I hereby personally assume all risks in connection with said activities, for any harm, injury, or damage that may befall me while I am involved in any of these activities, including all risks connected therewith, whether foreseen or unforeseen.

______ I further release and exempt said activities and Released Parties from any claim or lawsuit by me, my family, estate, heirs, or assigns,, arising out of my enrolment and participation in these activities, including both claims arising during the activities or after.

______ I also understand that skin diving and SCUBA diving cause physical strain or exertion not necessarily experienced in non-diving situations, and that I assume all risk for, and will not hold the Released Parties responsible for, any injuries, including injuries due to heart attack, panic, hyperventilation or other injuries caused by physical strain and exertion.

______ I further state that I am of lawful age and legally competent to sign this Release, or that I have acquired the written consent of my parent or guardian.

______ I hereby state and agree that this Release will be effective and valid for all specialised diving activities as defined above, for a period of One Year from the initial date on which I execute this Release.

______ I understand that the terms herein are contractual and not a mere recital, and that I have signed this document of my own free act.

______ I understand that this release covers ALL operations and boats (owners, skippers, and crews), owned by or chartered by the Seahorse Dive Club (its Officers and Members) and White Horse Diving (School) Instructors and support staff.

It is the intention of: _____________________________________(Diver) by this document, to exempt and release my Instructor(s), Divemaster(s), White Horse Diving, and/or the Seahorse Dive Club, and PADI International Inc, and related entities as defined above, from all liability or responsibility whatsoever for personal injury, property damage, or wrongful death, however caused, including but not limited to, the negligence of the Released Parties, whether passive or active.

I have fully informed myself of the contents of this liability release and assumption of risk by reading it before I signed it, on behalf of myself, and my heirs. I further understand and agree that this release is effective and valid for a period of One Year from the date on which I execute this release.
